LEGISLATION.
Tourist rentals are regulated by Catalan tourism legislation, and more specifically by Decree 159/2012, of November 20.
2. AGREEMENT AND MODIFICATIONS.
The terms listed below are a contract between the client and the owner of the house/apartment. Port Blanc Costa Brava SL acts as an intermediary and is responsible for the proper execution of the mediation, which is carried out in accordance with current legislation. These general conditions are governed, interpreted, and applied in accordance with Spanish law and the law of Girona (Spain).
By using the Port Blanc Costa Brava SL website, making reservations through this website, or at the Port Blanc Costa Brava SL office, the client declares that they have read these terms and accept them. These conditions are subject to change to improve the quality of the services provided.
3. RESERVATION AND PAYMENT CONDITIONS
Guests can reserve an apartment or house by phone, online, or in person at our office.
To do so, guests must pay 20% of the rental price.
Within the next 24 hours, guests will receive a confirmation email with the reservation and payment status.
On the day of arrival, guests must pay the remaining amount (in cash or by card) before collecting the keys.
Payment methods:
Bank transfer (at least one week before arrival).
Cash.
Bank card (online, by phone, or in person at the office).
For reservations made through third parties (travel agents, tour operators, or other employees authorized by Port Blanc Costa Brava SL), their payment terms apply.
4. MANDATORY FEES NOT INCLUDED IN THE PRICE. DEPOSIT.
The following fees are not included in the rental price and are mandatory:
– Catalonian tourist tax (€1 per night (max. 7 nights) for each person over 16 years of age).
– End-of-stay cleaning service (the cleaning fee varies depending on the accommodation, from €45 to €200, indicated on the booking form before payment).
Upon check-in, the guest must provide their credit card details as a deposit. The guest authorizes Port Blanc Costa Brava SL to debit their credit card, even after their departure, for any damage caused to them or any of their occupants in the rented house or apartment. This card details will be deleted from the database after the apartment/house has been verified after the guest's departure. No amount will be charged to your card, except in cases where defects are detected in the accommodation, furnishings, or household appliances, or in cases of severe dirt and debris. The cost of restoring the property to its previous condition will be deducted from your credit card.
The deposit can be paid in cash on the day of arrival and will be refunded on the day of departure, once the property has been inspected for its good condition.
5. CHANGES IN PRICES, SERVICES, PHOTOS.
Although the descriptions of the apartments/houses and their prices have been carefully prepared, they may still be subject to change at any time, which will be communicated at the time of booking and subsequently confirmed in writing.
It is also possible that such changes may occur after the booking has been confirmed and affect the basic provisions of the contract. In this case, the client may terminate the contract within five days and receive a full refund of the amount paid.

6. MINIMUM STAY, DAY AND TIME OF ARRIVAL/DEPARTURE, MAXIMUM NUMBER OF GUESTS.
The minimum stay varies by property and season and can range from one night to seven nights. This information can be found on the Port Blanc Costa Brava website and can also be obtained by phone or email.
Check-in time: Monday to Sunday, 4:00 PM to 8:00 PM. Arrivals after 8:00 PM incur an additional charge of €20.
Check-out time: The guest agrees to vacate the accommodation and return all keys by 11:00 AM on the day of departure. If the accommodation is not exempt, the guest will be required to pay double the contracted amount daily and will also be obligated to compensate for any damages they may have caused to other guests during the confirmed reservation.
Check-in and key collection take place at the Port Blanc Costa Brava office (C/Gregal, 52, L'Escala) or at the rental property upon arrival.
The maximum number of guests that each specific property can accommodate is limited and is specified in each specific description. The key holder and/or a Port Blanc Costa Brava SL representative may deny access if the maximum number of guests is exceeded.
7. RESERVATION CANCELLATION.
If the guest cancels the reservation within 24 hours of making it, cancellation will be free of charge and 100% of the amount paid will be refunded.
In the event of a no-show, the guest will lose 100% of the rental amount.
Cancellation and refund conditions depend on the check-in date:
Reservations with check-in:
From 09/15 to 11/15
From 12/20 to 01/06
From 03/16 to 06/14
Conditions:
If the cancellation is made more than 14 days before the check-in date, a 0% penalty will be applied to the rental amount.
If the cancellation is made less than 14 days before the check-in date, a 100% penalty will be applied to the rental amount.
Bookings with check-in:
From January 7 to March 15
From November 16 to December 19
Conditions:
If the cancellation is made more than 3 days before the check-in date, the penalty will be 0% of the rental amount.
If the cancellation is made less than 3 days before the check-in date, the penalty will be 100% of the rental amount.
Bookings with check-in:
From June 15 to September 14
Conditions:
If the cancellation is made more than 1 month before the check-in date, the penalty will be 0% of the rental amount.
If the cancellation is made less than 1 month before the check-in date, the penalty will be 100% of the rental amount.
For reservations made through third parties (travel agencies, tour operators, or other employees authorized by Port Blanc Costa Brava SL), their cancellation policies will apply.
In the event of force majeure (war, fire, or flood), Port Blanc Costa Brava SL reserves the right to replace the reserved accommodation with another accommodation of similar characteristics or cancel the reservation if the guest prefers a refund of the amount paid.
In the event of any serious contingency, Port Blanc Costa Brava SL reserves the right to terminate the contract within 24 hours of the guest's first payment being made, refunding the amount paid.
8. GUEST OBLIGATIONS AND RULES OF RESIDENCE.
Leave the Apartment or house, as well as the furniture (inside and outside), clean and in good condition (kitchen utensils must be clean, garbage must be in the appropriate containers outside the Apartment/house, the interior and exterior walls of the Apartment/house, windows, doors, and pool must not be damaged). In the event of damage or breakdown, the guest will be responsible for paying the cost of replacement or repair. If kitchen appliances or utensils (cutlery, plates, glasses, for example) are broken, the guest is obligated to replace them with the same or similar items during their stay in the Apartment or house. Alternatively, inform Port Blanc Costa Brava SL and pay the cost of the damaged items.
Refrain from carrying out activities in the Apartment/house that violate the rights and interests of neighbors, are harmful to the health of others, are dangerous, or are illegal. It is prohibited to store combustible or explosive materials or to engage in commercial or industrial activities. Do not re-rent the apartment or house to third parties, do not hand over the keys and the contract.
Comply with the internal rules, bylaws, and regulations provided in the common areas that are part of the homeowners' association. Refrain from making noise, especially after 10:00 PM.
Allow Port Blanc Costa Brava SL representatives to visit the apartment/house during business hours, with those interested in purchasing the property (only if the property is for sale). The number of visits cannot exceed two per week; the time of visits is agreed upon in advance with the tenants.
Report any damage that may occur in the apartment/house to Port Blanc Costa Brava SL for prompt repairs. Allow a Port Blanc Costa Brava SL specialist to enter the house/apartment at any time. Do not carry out repairs or hire outside personnel. Otherwise, any damage caused by these actions will be fully paid by the client.
Allow the gardener and pool care professional to perform their maintenance and watering of the garden and pool.
To prevent theft, do not leave personal belongings on the street (terrace or garden), and lock the doors and windows when leaving the house/apartment. The insurance policy covers the house/apartment, but not the client's personal belongings. The client assumes responsibility for the safety of the property, furnishings, and equipment, and agrees to leave them in the same condition upon departure. The client agrees to inform Port Blanc Costa Brava SL of any damage that may occur to the property for immediate repair. The client also agrees to grant access to the rental property to a technician sent by Port Blanc Costa Brava SL at any time agreed upon with the client.
It is strictly prohibited to carry out repairs on your own or with the help of others. Otherwise, any damage caused by this violation will be the client's responsibility.
9. CLEANING.
The property will be provided to the client clean. The client agrees to return the property in acceptable condition, free from trash and food scraps. Failure to do so will result in a €100 fine.
10. COMPLAINTS.
Should the client wish to leave a complaint or suggestion, they may do so by email or by phone at the Port Blanc Costa Brava SL address indicated on the website.
11. OBLIGATIONS of Port Blanc Costa Brava SL.
If a reserved accommodation has serious deficiencies that prevent its normal use, Port Blanc Costa Brava SL undertakes to find an alternative accommodation with similar characteristics and prices. If this is not possible due to a lack of available accommodation, or because the client rejects all offers, all or part of the rent paid will be refunded to the client.
Port Blanc Costa Brava SL's liability is limited to its role as an intermediary and does not include any other liability of the apartment/house owner.
Port Blanc Costa Brava SL assumes no liability in the following cases:
Negligence or omission of third-party services.
Failures in swimming pools, playgrounds, and sports facilities of any kind. Their use is also the user's responsibility.
Burglaries in residential premises.
Damage caused to persons or property as a result of force majeure or unforeseen circumstances.
In any case, Port Blanc Costa Brava's financial liability for any moral damages that may arise from its intermediation activity is limited to the amount paid for the rental.
12. PERSONAL DATA.
The customer consents to the inclusion of their personal data in the Port Blanc Costa Brava SL data system. The purpose of processing this data is to properly manage reservations. Unless otherwise indicated, the data may be used to send information about Port Blanc Costa Brava SL's goods and services, for which electronic means may be used. If a customer makes a reservation through a travel agency or partner company, their data may be transmitted to them for verification. In any case, the customer may exercise their right to correct or delete their data by contacting Port Blanc Costa Brava SL.
